Terms of Service

Welcome to alpharefinery.com. These Terms of Service (“Terms”) govern your use of this website and any landing page we operate. Please read them before using the site or booking an appointment. By using the site you agree to these Terms. If you do not agree, do not use the site.

1. Who we are

Alpha Refinery Medical is the assumed name of Wesley Nahm, M.D. of Illinois, P.C. (the “Practice”), a physician-owned professional corporation organized under Illinois law. The Practice provides all clinical services. All clinical decisions, including whether to evaluate, diagnose, treat, or prescribe, are made solely by the Practice’s licensed providers exercising independent professional judgment.

Alpha Refinery Management LLC (the “Management Company”) provides non-clinical administrative, technology, and marketing services, and operates this website. The Management Company does not provide, direct, control, or interfere with clinical care.

In these Terms, “Alpha Refinery,” “we,” “us,” and “our” refer to both entities acting within their respective roles.

2. Eligibility

You must be at least 18 years old and located in the United States to use this site or to become a patient. Our services are directed to residents of Illinois. Nothing on this site is an offer to provide health care services in any jurisdiction where we are not licensed to do so.

3. This website is not medical advice

All content on this site, text, images, graphics, videos, biomarker descriptions, and educational materials, is provided for general informational purposes only. It is not medical advice, and it is not a substitute for professional diagnosis or treatment.

Using this site, submitting a form, or booking an appointment does not create a provider-patient relationship. That relationship begins only when a licensed provider of the Practice accepts you as a patient following an evaluation.

Never disregard professional medical advice, or delay seeking it, because of something you read here.

4. Not for emergencies

This website and our services are not for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency department. Do not use this site, our forms, or text messaging to communicate an emergency.

5. Individual results

Outcomes vary from person to person. Nothing on this site is a guarantee, warranty, or prediction of any particular result. Descriptions of programs, biomarker panels, and services describe what we offer, not what you will experience.

6. Telehealth

Where we offer care by telehealth, it is available only to patients physically located in Illinois at the time of the visit, and only where a provider determines telehealth is clinically appropriate.

An in-person evaluation at our Hinsdale clinic is required before treatment begins, and periodic in-person visits are required to continue. Certain medications may only be prescribed following an in-person evaluation, and some may not be prescribed by telehealth at all. Whether any medication is appropriate is a clinical decision, and no medication is promised or included as part of any program or package.

Before your first telehealth visit you will be asked to review and sign a separate Telehealth Informed Consent.

7. Booking, accounts, and payment

Our site uses Boulevard for scheduling and payment processing. By booking or purchasing, you agree to:

Provide accurate, complete, and current information;
Keep your account credentials confidential and accept responsibility for activity under your account;
Pay all fees associated with the services you book; and
Comply with any additional terms imposed by Boulevard or our payment processor.

We do not bill insurance. Fees are disclosed before you book. HSA and FSA funds are generally eligible for qualifying services; confirm eligibility with your plan administrator. We may cancel or reschedule an appointment where clinically necessary or where circumstances require, and we will contact you if we do.

8. Membership terms

Initial 90-day program

Your first 90 days are the minimum initial program period. The Initial 90-Day Program Total is collected in full at enrollment.

Month-to-month membership

After your initial 90 days, your membership automatically continues month-to-month. There is no long-term contract.

Cancellation

You may cancel at any time by giving written notice to Alpha Refinery at [email protected], or by mail to the address in Section 24. Your notice is effective when we receive it, and we will confirm receipt in writing.

To stop an upcoming monthly renewal, we must receive your cancellation notice at least 30 days before your renewal date. If notice arrives fewer than 30 days before your next renewal, that renewal will occur as scheduled and will be your final renewal. You will not be charged again after it.

Example: if your renewal date is 15 September, we must receive notice by 16 August to stop the 15 September renewal.

Monthly charges are not prorated

Monthly charges cover full membership cycles and are not prorated. The notice period exists so that we can coordinate your care, including medications that may be ordered or fulfilled in advance in full monthly quantities.

Guest Pass

After 90 days of continuous membership you receive one complimentary Performance & Longevity Assessment Guest Pass per membership year. The Guest Pass expires 60 days after it is issued, has no cash value, and is subject to clinical eligibility and scheduling availability. Your guest must be 18 or older and must not be a current or former Alpha Refinery patient. We may modify or discontinue this benefit at any time.

Our commitment

After your first 90 days there is no long-term commitment. We have to earn your membership every month.

Prepaid packages

Prepaid packages are valid only at Alpha Refinery and are non-transferable.

9. Gift cards

Gift cards are redeemable only at Alpha Refinery, are non-transferable, and are not redeemable for cash except where law requires. Gift cards do not expire except as permitted by applicable federal and Illinois law. Promotional offers cannot be combined unless we say so expressly, and may carry stated conditions.

10. Text messages and telephone calls

If you give us your mobile number, you agree that we may contact you by call and text about your appointments and your care.

Consent to receive marketing text messages is not a condition of receiving care or of purchasing anything from us.
Reply STOP to opt out of further messages. Reply HELP for assistance. Message and data rates may apply, and message frequency varies.
We do not sell, rent, or share mobile numbers or text message consent with third parties or affiliates for their own marketing.
Text messaging is not secure and must never be used for emergencies or for urgent clinical matters.

Calls may be monitored or recorded for quality and training purposes where permitted by law and where you have been notified.

11. Privacy

Our Privacy Policy explains how we handle information collected through this site. Protected health information is governed separately by the Practice’s Notice of Privacy Practices. Where the two conflict as to protected health information, the Notice of Privacy Practices controls.

12. Intellectual property

All content on this site, including text, logos, images, video, design elements, protocols, and trademarks, is owned by Alpha Refinery or its licensors and protected by United States and international law. You may view and print pages for your own personal, non-commercial use. You may not reproduce, distribute, modify, publish, scrape, or create derivative works from any content without our prior written consent.

13. Content you submit

If you submit a review, testimonial, photograph, or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display it in connection with our services. You confirm you own it or have the right to grant that licence.

Do not submit protected health information through public channels such as reviews or social media. If you do, we may be limited in how we can respond, because privacy law restricts what we may disclose publicly, including confirming whether you are a patient.

14. Acceptable use

You agree not to use this site to break the law, infringe anyone’s rights, transmit malicious code, attempt to gain unauthorised access to our systems or accounts, scrape or harvest data by automated means, or interfere with the operation of the site.

15. Third-party links and services

This site links to and integrates with services we do not control, including Boulevard, laboratories, pharmacies, payment processors, and social media platforms. We are not responsible for their content, policies, or practices, and a link is not an endorsement.

16. Disclaimer of warranties

This website and its contents are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the site will be uninterrupted, secure, or error-free. Your use of the site is at your own risk.

Nothing in this section limits or disclaims any duty a licensed provider owes you in the course of clinical care, and nothing in these Terms is intended to limit liability for professional negligence.

17. Limitation of liability

To the fullest extent permitted by law, Alpha Refinery and its affiliates, officers, employees, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of or inability to use this website, even if advised of the possibility. Our total aggregate liability arising from your use of this website will not exceed one hundred dollars ($100).

This section applies to your use of the website. It does not apply to, and does not limit, liability arising from clinical care.

18. Indemnification

You agree to indemnify and hold harmless Alpha Refinery, its affiliates, and their respective officers, employees, and agents from any claim, damage, liability, or expense, including reasonable attorneys’ fees, arising from your use of this website or your breach of these Terms.

19. Accessibility

We are working toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. If you encounter a barrier to using this site, contact us at the details in Section 20 and we will work with you to provide the information or service you need in an accessible form.

20. Termination

We may suspend or terminate your access to this website at any time, for any reason, without notice. Termination of website access does not by itself end a provider-patient relationship, which is governed by the Practice’s clinical policies and applicable law.

21. Governing law and venue

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws principles. Any dispute arising out of these Terms or your use of this website shall be resolved exclusively in the state or federal courts located in DuPage County, Illinois, and you consent to the jurisdiction of those courts.

22. General

If any provision of these Terms is held unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for failure to perform due to causes beyond its reasonable control. These Terms, together with the Privacy Policy and any agreement you sign as a patient, are the entire agreement between us regarding this website.

23. Changes to these Terms

We may update these Terms. Changes take effect when posted on this page, and we will update the date at the top. Your continued use of the site after a change constitutes acceptance of the revised Terms.
